Terms of Service

Terms governing your access to and use of the KonaSense Services.

Effective Date: January 16, 2026

These Terms of Service ("Terms") govern your access to and use of the KonaSense website, products, and services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Who We Are

"KonaSense," "we," "us," and "our" refer to the KonaSense entity operating the Services.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

3) Acceptable Use

You agree not to:

  • Use the Services for unlawful, harmful, or fraudulent activities.
  • Attempt to gain unauthorized access to systems or data.
  • Interfere with or disrupt the Services, including introducing malware.
  • Reverse engineer, decompile, or attempt to extract source code except where permitted by law.

4) Accounts and Security

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any suspected unauthorized access.

5) Customer Content

If you submit content to the Services (e.g., form submissions, messages, files, or other information) ("Customer Content"):

  • You retain ownership of your Customer Content.
  • You grant us a limited license to host, process, transmit, and display Customer Content only as needed to provide and improve the Services, comply with law, and enforce these Terms.

6) Feedback

If you provide feedback or suggestions, you grant us the right to use them without restriction or obligation to you.

7) Third Party Services

The Services may integrate with or link to third-party services (e.g., identity providers such as Google Workspace, cloud services, analytics tools). We are not responsible for third-party services, and your use of them is subject to their terms and policies. See our Google IdP Privacy Policy for Google Workspace integrations.

8) Intellectual Property

The Services, including software, designs, logos, and content (excluding Customer Content), are owned by KonaSense or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works except as expressly permitted.

9) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, KONASENSE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KONASENSE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KONASENSE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO KONASENSE FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100 IF YOU HAVE NOT PAID ANY AMOUNTS.

11) Indemnification

You agree to indemnify and hold harmless KonaSense from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Services, your Customer Content, or your violation of these Terms.

12) Termination

We may suspend or terminate access to the Services if we reasonably believe you have violated these Terms, you pose a security risk, or we are required to do so by law. You may stop using the Services at any time.

13) Changes to the Services or Terms

We may modify the Services and these Terms from time to time. When we do, we will update the Effective Date. Your continued use of the Services after changes become effective constitutes acceptance.

14) Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
